A hernia is a medical condition in which an organ breaks through the muscle or tissue that keeps it in its place. To repair a hernia, a prosthetic known as a hernia mesh is attached to the damaged or weakened muscle or tissue to help strengthen the tissue and hold it together. When the mesh work properly, it helps the damaged muscle or tissue strengthen and holds the organs in their place.
The problem with hernia mesh is that there is a risk for a range of complications and injuries if the mesh used was defective or not implanted correctly. In fact, many manufacturers of hernia mesh implants have issued recalls after the discovery that their implants were causing complications and injuries to those who have received them. If you or a loved one has received a hernia mesh implant and suffered injuries or other complications from the mesh, you can file a hernia mesh lawsuit against the manufacturer and get compensation.

Why File a Hernia Mesh Lawsuit?
Hernia surgeries are quite common as an average of one million hernia surgeries are done each year. In the majority of hernia operations, a hernia mesh is used to help repair the damaged muscle or tissue. However, approximately one in three people experience chronic pain and other complications after a hernia surgery, and the hernia mesh is often responsible.
By law, hernia mesh manufacturers must disclose known issues or hazards with their products. Despite this, some manufacturers still marketed and sold their defective hernia mesh products without disclosing the risks. This has caused many hernia patients to suffer additional pain and complications and resulted in many lawsuits and recalls of defective mesh implants. The basis of many hernia mesh lawsuits is that manufacturers did not adequately warn patients of the known risks and side effects.
If you have suffered from chronic pain or complications after receiving a hernia mesh implant, you need to take action immediately. Hernia mesh lawsuits come down to product liability and there is a statute of limitations of 2 years from the date that the product was acquired for product liability cases in Illinois. In Indiana, product liability claims must be filed within 2 years of the date of your injury and within 10 years of when the product was acquired. If you do not file your hernia mesh lawsuit within the statute of limitations in your state, your claim will not be valid.
Make sure you call Good Law Group as soon as you start experiencing complications after your hernia surgery.
Injuries and Complications from Hernia Mesh
There is a sizeable list of injuries and complications that can be caused by hernia mesh, including chronic pain, indigestion, and sexual dysfunction. Many hernia mesh complications and injuries arise from one of the following:
- Infection: Every surgery includes a risk of infection, but this risk is high with hernia mesh. Infection often occurs when the mesh becomes contaminated before being implanted or after surgery. A severe infection will require a second surgery to have the mesh removed.
- Mesh migration: Hernia mesh is supposed to adhere to the damaged areas, but sometimes it may move and shrink after implantation. When this happens, it can perforate or tear organs and block the intestines. These complications can be life threatening.
- Mesh erosion: Some hernia mesh implants were manufactured with cheaper materials that erode over time within the body. When this happens, it can cause severe pain and the hernia may reoccur, resulting in a second hernia surgery.
There are many injuries and complications that can occur from defective hernia mesh implants. The following are the most common complications:
- Adhesion: Adhesion occurs when the mesh sticks to internal tissues. This is more likely to happen with coated meshes.
- Erosion: Mesh erosion discussed above can lead to infection, pain, nausea, damage to internal organs, fever, and dangerous intestinal blockages.
- Abdominal pain: Abdominal pain may result if the mesh adheres to the abdominal wall or if there is nerve damage, infection, or bowel obstruction.
- Bowel obstruction: This occurs when the mesh migrates or adheres to tissue within the bowels which can cause constipation or diarrhea.
- Infections: Infections caused by defective hernia mesh implants can include fever, sweating, and severe headaches. Severe infections can lead to sepsis.
- Perforation of organs or tissues: Eroding or migrating mesh implants can perforate organs and tissues. Some who are affected need to have their bowels partially removed or use colostomies.
- Chronic pain: Mesh failure can cause inflammation which causes chronic pain in connective tissues and joints throughout the body.
- Recurrence of hernia: If the mesh fails, your hernia can reoccur and result in a second surgery.
- Groin or testicular pain: Groin or testicular pain may occur and damage to the spermatic cord could result in removal of the testicles.
- Cancer: It is possible for infected mesh implants to cause cancer to develop.
- Other complications: Other complications and injuries that can occur from hernia mesh implants include renal failure, liver problems, rash, dyspareunia (painful sex), sexual dysfunction, autoimmune disorders, neurological changes, and dental issues. Each person may experience different side effects.
Hernia mesh injuries and complications can result in the following damages that you can name in your lawsuit:
- Economic damages: Economic damages can include medical bills, loss of earning capacity, and loss of wages.
- Non-economic damages: These include emotional distress, pain, mental anguish, loss of enjoyment, and loss of consortium.
- Punitive damages: This is used in rare cases to bring punishment to the manufacturers.
Filing a Hernia Mesh Lawsuit
If you believe you are suffering from the above-mentioned conditions due to a defective hernia mesh, contact our attorneys at The Good Law Group immediately to discuss your case. We can file a hernia mesh lawsuit on one of the following four grounds:
- Defective design: Manufacturers of hernia mesh implants can be held liable if the there are design flaws in the mesh the posed a foreseeable risk and it was used and implanted correctly. This can also cover the use of materials like polypropylene that can deteriorate and cause infections within the body.
- Manufacturing defect: Manufacturers can be help liable for manufacturing defects of the mesh if the implant had a manufacturing defect when it left the manufacturer and if the defect caused the pain or complications.
- Failure to warn/ improper labeling: Manufacturers of medical devices such as hernia meshes must disclose all possible risks so that doctors and patients are well-informed. They could be held liable if they do not warn physicians of the non-obvious dangers of the product or how to avoid these dangers.
- Medical malpractice: Medical malpractice suits can be brought if the surgeon does not implant the mesh correctly or uses the wrong type or size hernia mesh. With these lawsuits, we would have to prove that the surgeon had a duty of care to the patient, breached that duty by failing to meet professional standards of care, and that this breach caused the injury or complications.
Hernia Mesh Recalls
As mentioned above, some hernia mesh implants have been recalled because of the injuries and complications they cause. If you discover that the mesh implant you were given was recalled, call your doctor right away. You may need an additional surgery to either repair or remove a defective hernia mesh. Once you call your doctor, contact our hernia mesh attorneys at The Good Law Group. You can still file a lawsuit and hold someone accountable for your injuries, even if your mesh implant was recalled.
There are plenty of manufacturers of hernia mesh implants that have issued recalls. Look up the manufacturer of your hernia mesh implant to see if a recall has been issued.
